Public presentation of the Draft-bill on EU Funds Management

Many of BCCI’s proposals made earlier are included in the bill




BCCI took part in the discussion of the Draft-bill on EU Funds Management. The Minister of EU Funds Management Tomislav Donchev presented the goals of the bill, its scope, structure and the contents of the specific sections. 

The bill comes in response to the growing need to establish a unified and flexible approach to the management of programmed funded by the EU. The concept provides a general framework for efficient coordination of the process and cooperation of all participants in the future programming period 2014 – 2020. 
 
The bill provides for the introduction of a simplified application, containing all major administrative categories. Each managing authority will be able to add columns with additional requirements depending on the respective operational programme. 
 
An important element of the bill will be the introduction of electronic application, reporting and communication. The application forms will be submitted electronically. They can be submitted on paper only if the electronic filing is impossible or if the beneficiary explicitly insists on having them on paper. 
 
The bill envisages a new procedure for dealing with complaints to be introduced. The first stage would include referring the claim to the respective Minister. After he passes a ruling, the beneficiary may refer the claim directly to the Supreme Administrative Court. Thus higher transparency and shorter terms for appeal will be guaranteed.
 
The other new points in the bill include removing the authorities responsible for the Operational Programmes management from the administration of the separate ministries, introducing a simplified selection of contractors – through public invitation sent to at least three executors for procurement activities above certain thresholds, setting up a unit to organize specialized trainings for the beneficiaries and public administration officials working with EU funds. 
 
Many of the proposals and previous positions of the Bulgarian Chamber of Commerce and Industry, expressing the requirements of its members, were taken into consideration when drafting the bill. The Chamber hopes that the practice of successful cooperation will continue in the future. 
 
In January 2013 the draft-bill will be proposed for public discussion by all interested parties.
