A level playing field for private and state enforcement agents is needed and then let the better ones be more demanded and more motivated

The Bulgarian Chamber of Commerce and Industry continues to encourage and support the Bulgarian Chamber of Private Enforcement Agents. As the largest employers’ organization we are interested in cooperation with the Chamber. Our successful project to expand the activity of the Arbitration court with the BCCI is very important for the private enforcement agents. For the past 3 years the cases tried by the Arbitration court have tripled both in number and in size of the claims. The terms remain short. The parties, the arbitrators and the court experts already have electronic access. I can responsibly say that we are among the leading Arbitration courts in Europe and in the world - not only in number but also because of the way we provide this service. Our partners are surprised by the number of cases and their annual growth. That is why, as far as cooperation with the Bulgarian Chamber of Private Enforcement Agents is concerned, we will be glad if you provide us with feedback on our arbitral awards. Because you are related to the execution of these awards, we would be grateful to hear your insights and suggestions on how to improve the work of the Arbitration court. 
We have supported position-papers about the development of private law enforcement. With me I have the last one we supported – a disagreement with the unequal treatment of private enforcement agents who, unlike the enforcement agents subordinate to the Minister of Justice, have to pay fees.
We have our expectations for private law enforcement as well – to be a bit quicker, not that the impact of any administration or institution in Bulgaria has such terms, but if it is possible to work even more actively for the removal of measures once a debt has been paid. We will support the idea private enforcement agents to have access to banks’ information databases. Our experts in this field inform us that private enforcement agents still don’t receive timely information when a bank account is garnished, what sum is in it and whether the claim of the creditor can be paid by this account and other accounts. We will be at your disposal to discuss any additional topics which may help improve private law enforcement. Obviously, together we should work for a level playing field for the private and state enforcement agents and then let the better ones be more on demand and more motivated.
